i was clicking through themes.tiki.org, and see this secondary menu shifting to the lef when I scroll the page, is that intentional?
i like the new design, maybe should hae started with this :)

Yes, that's how the script works, I think (that luci added).
Maybe the menu could be kept in the same position rather than shifting. I didn't look at that possibility.

i think it would be better, not so much effects
also the topbar menu is slightly higher than the background
there is a 2px difference
maybe 1px

Yes, I saw that too. luciash may know how to fix that.
I tinkered a little with firebug but didn't see how to fix it.

in short, one simple way (for a dev like you) is to translate your language.php in trunk and backport your strings translated to your brach also
